Terms of service

1. Scope and acceptance

These Terms and Conditions of Sale (“Terms“) govern the contractual relationship between:

Kelyon Group LTD, a company registered in England and Wales under company number 17194219, with registered office at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, trading as MARGO (“the Seller“, “we“, “us“, “our“),

and any natural person aged 18 or over acting in a personal capacity outside any commercial activity (“the Customer“, “you“, “your“) placing an order on margo-paris.com (“the Site“).

Placing an order on the Site implies the Customer’s full and unreserved acceptance of these Terms in their version in force at the date of the order.

The Seller reserves the right to amend these Terms at any time. The version applicable is the one in force at the time the order is placed.

2. Products

The products offered for sale are those displayed on the Site at the time of consultation, within the limit of available stocks. The Seller takes the greatest care in presenting the products: characteristics, photographs, dimensions and colours are described as accurately as possible, but minor variations may exist due to screen rendering or to the artisanal nature of leather goods.

In the event of unavailability after the order has been confirmed, the Customer is informed by email as soon as possible and reimbursed in full within fourteen (14) days.

3. Prices

Prices are displayed in Euros (EUR, €), inclusive of VAT where applicable.

Shipping costs are added to the product price and shown clearly before order confirmation. They are detailed in our Shipping Policy. We currently ship to France, Belgium, Luxembourg, Germany, Italy, Spain, Portugal and Switzerland.

Customs duties and Swiss VAT for shipments to Switzerland are payable by the recipient.

The Seller reserves the right to change prices at any time. Products are invoiced at the prices in force at the time the order is registered.

4. Order process

  1. The Customer selects the products and adds them to the basket.
  2. The Customer reviews the basket, applies any voucher code, then proceeds to checkout.
  3. The Customer fills in delivery and billing details, selects a delivery method, and accepts these Terms.
  4. The Customer is redirected to the secure payment page.
  5. Once payment is confirmed, the Seller sends an order confirmation by email recapping the order, the price paid and the delivery details. This email constitutes the acceptance of the order by the Seller and the formation of the contract.

The Seller reserves the right to refuse or cancel any order in the event of: a dispute relating to a previous order, suspected fraud, manifestly erroneous price, breach of these Terms, or refusal of payment by the banking institution.

The Customer must keep the order confirmation, which constitutes proof of purchase.

5. Payment

Payment is made online at the time of the order, by:

  • Debit/credit card (Visa, Mastercard, American Express)
  • Apple Pay, Google Pay
  • PayPal (where available)
  • Buy Now Pay Later in 3 instalments at no interest, via Klarna or Clearpay (eligibility check at checkout, subject to provider’s terms)

All transactions are secured by SSL/TLS encryption and 3D Secure 2 strong customer authentication, in compliance with PSD2 (UK and EU). Card details are processed directly by our PCI-DSS certified payment service provider and are never stored on our servers.

The Seller retains ownership of the goods until full payment has been received.

6. Delivery

Delivery zones, timeframes, services and costs are detailed in our Shipping Policy.

Delivery times are indicative. They start from confirmation of the order and dispatch of the parcel.

If delivery exceeds thirty (30) days from the date of the order without prior written agreement of an extended timeframe, the Customer may cancel the contract and obtain a full refund within fourteen (14) days, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Risk of loss or damage of the goods passes to the Customer (or to a third party other than the carrier indicated by the Customer) at the time the goods are physically delivered.

7. Right to cancel — 30-day extended return window

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Articles L.221-18 et seq. of the French Consumer Code, the Customer has a statutory right to cancel the contract within fourteen (14) days of receipt of the goods, without giving any reason.

The Seller voluntarily extends this period to thirty (30) days.

To exercise the right to cancel, the Customer informs the Seller of the decision by an unequivocal statement, by email at contact@margo-paris.com, or by using the model cancellation form below.

8. Statutory rights and warranties

8.1 — EU statutory guarantee of conformity

For Customers resident in France and other European Union countries, the goods benefit from the legal guarantee of conformity provided by Directive (EU) 2019/771 (and, in France, Articles L.217-3 et seq. of the Consumer Code). The Customer is entitled, free of charge, to a repair or replacement of any non-conforming goods within two (2) years from delivery, and may benefit from a price reduction or termination of the contract under the conditions set by law.

The goods also benefit from the legal warranty against hidden defects (in France, Articles 1641 et seq. of the Civil Code), allowing the Customer to obtain a refund or price reduction within two (2) years of discovery of the defect.

8.2 — Switzerland

For Customers resident in Switzerland, the goods benefit from the statutory warranty for defects under Articles 197 et seq. of the Swiss Code of Obligations (CO), giving the Customer the right to a repair, replacement, or refund in case of non-conformity discovered within the statutory warranty period.

8.3 — Exercise of statutory rights

To exercise these statutory rights, contact contact@margo-paris.com with the order number, a clear description of the defect and supporting photographs. The Customer’s statutory rights are not affected by these Terms.

9. Liability

The Seller’s liability is limited to the amount of the order in question, except in cases of gross negligence, wilful misconduct, death or personal injury, or where liability cannot be limited or excluded under applicable consumer protection laws.

The Seller cannot be held liable for non-performance or delays caused by an event of force majeure, including but not limited to: natural disasters, strikes, transport disruptions, sanitary crises, governmental measures, telecommunications failures, cyber attacks.

11. Personal data

The processing of personal data is governed by our Privacy Policy, compliant with the UK GDPR, the Data Protection Act 2018 and — for EU residents — the EU GDPR (Regulation (EU) 2016/679).

12. Alternative dispute resolution

In the event of a dispute, the Customer is invited to contact our Customer Care team first. If no amicable solution is reached:

  • French residents: in accordance with Article L.616-1 of the French Consumer Code, the Customer may refer the dispute free of charge to the consumer mediation body designated by the Seller — [MEDIATEUR_FR_TBD]
  • EU residents: Online Dispute Resolution platform of the European Commission — https://ec.europa.eu/consumers/odr/
  • Swiss residents: in accordance with the Swiss Federal Act on Unfair Competition, the Customer may contact the cantonal consumer affairs office or the Swiss Foundation for Consumer Protection (SKS / FRC).

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to the mandatory consumer protection provisions of the Customer’s country of residence (Rome I Regulation, Article 6, where applicable).

14. Severability — Headings — Entire agreement

If any provision of these Terms is held to be invalid or unenforceable by a competent court, the remaining provisions shall continue to apply. Section headings are inserted for convenience only and have no contractual value. These Terms, together with the order confirmation, constitute the entire agreement between the parties.
